These Terms of Use ("Terms") govern access to and use of the Mallow mobile application (the "App"), and, where applicable, our website and content.

By downloading, installing, or using the App, you agree to these Terms.

02Service description

⚠️ Mallow is not a medical device and does not replace professional medical advice. If you have concerns about your child's health, consult a qualified healthcare professional.

Mallow provides soothing sounds (e.g., white noise, calming ambiences) designed to help create a consistent, calmer environment, especially around sleep.

03Access – no accounts

Mallow does not offer account creation. Some preferences may be stored locally on your device.

04Eligibility

You must:

•Have the legal capacity to accept these Terms.

•Use the App in compliance with applicable laws and regulations.

05License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Mallow for personal, non-commercial purposes on devices you own or control, in accordance with the App Store rules.

You may not (unless expressly permitted by law):

•Copy, modify, distribute, sell, rent, lease, lend, decompile, disassemble, or attempt to extract source code.

•Bypass technical protections.

•Use the App unlawfully, abusively, or fraudulently.

06Subscription, billing, and renewal

Mallow may offer a monthly subscription that unlocks premium features.

•Purchases and payments are handled by Apple through the App Store.

•Subscriptions automatically renew unless canceled before the end of the current billing period.

•Pricing and duration are shown in the App Store purchase flow at the time of subscription.

Premium entitlement management: Mallow uses RevenueCat as a technical service provider to verify and enable premium access (subscription status).

07Trials, promotions, and price changes

If a free trial or promotional offer is available, the terms (duration, price after trial, etc.) will be displayed at purchase.

Prices may change. Any changes apply in accordance with App Store rules, and Apple will notify you where required.

08Cancellation and subscription management

You can manage or cancel your subscription at any time via: iOS Settings → your name → Subscriptions → Mallow.

Cancellation takes effect at the end of the current billing period (you keep premium access until then).

09Refunds

Refund requests are handled by Apple according to its policies and procedures. We cannot issue direct refunds for App Store purchases.

10Availability, updates, and changes

We strive to keep Mallow available, but we do not guarantee uninterrupted access. We may:

•Fix bugs.

•Improve features.

•Modify or discontinue parts of the service.

•Release updates (sometimes required for continued operation).

11Content and intellectual property

The App, its design, sounds, content, trademarks, logos, and related materials are protected by intellectual property laws and belong to the publisher or licensors.

No rights are transferred beyond the license granted in Section 5.

12Limitation of liability

•We are not liable for indirect damages (loss of data, loss of profits, etc.).

•Our total liability will not exceed the amount you actually paid for Mallow in the last 12 months, or €0 if you paid nothing.

You are responsible for how you use the App and for safe listening conditions (volume, duration, etc.).

13Third-party services

The App may rely on third-party services (e.g., App Store, RevenueCat). Those services are governed by their own terms.

14Suspension / termination

We may suspend or limit access to the App if you misuse it, commit fraud, breach these Terms, or where required by law.

15Changes to these Terms

We may update these Terms. The "Last updated" date reflects the current version. If changes are material, we may notify you by reasonable means.

16Governing law and jurisdiction

Unless mandatory rules provide otherwise, these Terms are governed by the laws of France.

Disputes will be subject to the competent courts of [City], subject to consumer protection rules.
